Your use of this website is governed by these Terms and Conditions. Please take a moment to read and review these terms and conditions. Your us of the fluxdefleur.com website constitutes your agreement to follow these rules and regulations and to be bound by them. By placing an order with Flux De Fleur, either through the Website, over the Phone, or by any other source, you are agreeing to our Terms and Conditions. You must be over 18 years or older and have a valid credit/debit card, with full authority to use it, to order the products. If you do not agree with these Terms and Conditions, please do not use the fluxdefleur.com Website.

Definitions

“Seller/we/our/us/Flux de Fleur” means Flux de Fleur Limited, 27 Bury Old Road , Manchester, M25 0EY (registered in England, company registration no. 10453636) and the company's website www.fluxdefleur.com.


“Customer” means the person or company to whom this document is addressed.


“International Customer” shall mean, “Customer” from outside the United Kingdom.


“Website” shall mean, www.fluxdefleur.com or any other subdomains of fluxdefleur.com. which may be accessible unless expressly excluded by their own terms and conditions.


“Order” shall mean the submission of an order for products on the “Website” by the “Customer”

1. General

1.1 These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as Flux de Fleur, to the buyer hereafter referred as the Customer.


2. Price

2.1 The prices of the goods will be as quoted on the Website from time to time. We take reasonable care to ensure that the prices of goods are correct at the time when the relevant information was entered onto the system. However if we discover an error in the price of Product(s) you ordered, please see clause 2.4 for what happens in this event.

2.2 Prices for our goods may change from time to time, but changes will not affect any order which we have confirmed.

2.3 All prices are quoted in GB Pound Sterling and include VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.

2.4 The Website contains a large number of products. It is always possible that, despite our reasonable efforts, some of the products on the Website may be incorrectly priced. If we discover an error in the price of the products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order.


2.5 We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect (lower) price.

3. Payment

3.1 Payments can be made by way of the currency applicable to the country in which the order is placed from, and by one of the following payment methods (see clause 14)

3.2 Major credit cards as listed: Visa, MasterCard, American Express, Maestro, and Visa Electron

3.3 Any discount codes issued are strictly subject to the individual terms and conditions with which they were issued, which may include, amongst other things, eligibility of use and maximum order value. If any of the terms and conditions with which the discount codes were issued contradicts these terms and conditions, the terms and conditions in respect of the discount code will prevail.

3.4 We reserve the right to reject or cancel any orders which do not comply with these terms even if your credit or debit card has been charged (and will refund in full any amounts paid by you in respect of the order).

3.5 In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

·         Pay later.

·         Slice It.

4. Passing of Property

4.1 Flux de Fleur shall retain the property of the goods until full payment has been made by the Customer and has been received. The Customer will own the goods once full payment has been received by Flux de Fleur.


5. Orders

5.1 All Orders are subject to acceptance and availability. Upon placing an Order with Flux de Fleur, the Customer will receive an order acknowledgement and subsequent update email(s).

5.2 Receipt of the acknowledgement and these emails does not confirm that the Order has been accepted by Flux de Fleur.

5.3 Order acceptance and the creation of the contract between Flux de Fleur and the Customer will start at the time the products ordered by the Customer are dispatched from Flux de Fleur’s warehouse to be delivered to the address supplied by the Customer.

5.4 Flux de Fleur will take all reasonable care, in so far as it is in its power to do so, to keep the details of the Customer’s Order and payment secure, but in the absence of negligence on its part Flux de Fleur cannot be held liable for any loss suffered by Flux de Fleur if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

5.5 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk.

5.6 Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

5.7 Products purchased from Flux de Fleur are not for re-sale or distribution. Flux de Fleur can at its sole discretion restrict ordering to a maximum of 5 pieces of any individual products and reserve the right to cancel any Orders which are suspected are being purchased for re-sale or distribution.

6. Delivery

6.1 Any date or period for delivery shall be considered as indicative only.

6.2 It is our policy to try to despatch all orders within 5 working days unless otherwise specified.

6.3 Any products not available at the time of your order will be sent to you, as soon as possible, when received from the supplier. In any case, delivery will be made in accordance with the delivery specified at the time of when the order is placed. 

6.4 If there are delays in the delivery caused by the the carrier or any other third party then Flux de Fleur will not be liable for such delay. Furthermore if any amendments are made on the consignment by the receiver Flux De Fleur will not be liable for any lost or damages. 

6.5 We deliver to the countries listed on the Website, subject to our absolute discretion, (“International Delivery Destinations”).

6.6 If you order goods from the Website for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.

6.7 You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

6.8 You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such law.

7. Shipping

7.1 All Orders will be delivered using the service as detailed at time of ordering.

7.2 Shipping times vary based upon the destination and the Customer will be prompted with a delivery estimate on the ‘checkout’ page.

7.3 Please note that delivery times are based on courier estimates and are not guaranteed.

7.4 The Customer must request any other delivery method at the time of order.

8. Passing of Risk

8.1 The Customer will assume risk of the products ordered once they have been despatched to the address specified on the Order. Flux de Fleur accept no liability for undelivered parcels where the Customer provides an incorrect or invalid delivery address and/or fails to collect the Order from the delivery address specified following our reasonable efforts to contact you to deal with this.

8.2 In the event of an order being lost by a third party which has either been authorised by you to accept the products or a courier commissioned by you to deliver the products, Flux de Fleur bears no risk once it has been delivered to them. Where goods have been received damaged, a full refund will be made if we are notified of the problem within 24 hours  of delivery by email or otherwise in writing. You will then be required to return the goods together with their original packaging to the  Flux de Fleur trading address, also see clauses 9 and 10, below.

8.3 Where the goods are signed for, the customer bears the risk once the goods are signed for (provided they are signed for by the customer or a person identified as authorised by you). If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods (for the avoidance of doubt, signature for the parcel does not affect your rights of return under clause 10).

9. Title and Defects

9.1 The Products shall be owned by you once we have received payment in full for the Products.

9.2 The Customer shall inspect the goods within a reasonable time after their receipt. The Consumer Rights Act 2015 says products must be as described, fit for purpose and of satisfactory quality.

9.3 The Customer shall notify the seller in writing or by email within 24 hours of delivery if the goods are faulty or misdescribed and shall be entitled to a full refund, to get the product repaired or exchanged. (please see clause 10 below)

10. Refunds/Cancellations/Returns Procedure

Due to Covid-19, products cannot be returned. Please chose carefully when ordering. 

10. 1 We will not be able to offer a refund on any Flux De Fleur Floral Arrangement due to change of mind as our arrangements are live florals that are custom made to order and no refunds or store credit will be issued. 

10.2 Please note it is normal for cracking to appear on the rose petals as seen in pictures and no returns can be made on this basis. 

10.3 If the goods are to be rejected, the Customer shall comply with the return procedure as defined in this clause 10.

10.4 Flux de Fleur will not accept any returned goods should the return not follow the aforementioned return procedure.


10.5:
10.5 a) If any item is faulty we are happy to replace or exchange the item. Within 48 hours please notify our team by emailing info@fluxdefleur.com your order number along with a description of the faulty item, only then will a exchange or replacement be valid.

10.5 b)  Return the item in its original condition and packaging within 5 business days of receipt. 

10.5 c) All items should be unused and must be returned in their original packaging with all enclosed documentation. 

10.5 d) The item is solely your responsibility until it has been received back. We recommend for your own security you return the parcel using a tracked delivery method which then shall allow you to insure the content of your package.

10.5 e) Please attach a covering letter with any faulty item to include your order number, name, address, phone number and description of fault.

10.5 f) Once we receive the package sent to us, we will review the items and if approved we will process your exchange. We will process your exchange within 48 hours of receiving.

10.5 g) All faulty items must be sent back to our HQ, Flux De Fleur, Albert Iron Works, Bridgefield Street, Manchester, M262SG

10.5 h) once the item has been examined and we are satisfied that a refund is applicable we will aim to process your refund within a reasonable period of time, usually 7-10 working days. Shipping charges will be deduced when no fault of our own.  
 
10.5 i)  the Customer will be responsible for the cost of returning the item to Flux de Fleur unless otherwise negotiated. 

10.5 j) Goods must be returned to Flux de Fleur before any refund can be issued.

10.6 In cases where the rejection of the goods is due to a defect of the product, the Customer is entitled to a full refund within 14 days of the date of delivery of the products provided the returns procedure in this clause 10 has been fulfilled. 

10.7 Should there be a discrepancy  in the order made by Flux de Fleur, the Customer is entitled to exercise one of the following options available:

  • a full refund within 14 days of the date of delivery of the products (provided no prior agreement has been agreed i.e discounts/partial refund); or 
  • an exchange for the correct item that was initially ordered,

provided the returns procedure in this clause 10 has been fulfilled.

 

10.8 The rights described in clauses 10.3 and 10.4 are a summary of your key legal rights. For more detailed information please visit the Citizens Advice website at www.adviceguide.org.uk.

We encourage you to carefully check your order before submitting it.

11. Cancellations

11.1 Cancellations are not permitted. In the event the Customer has made a discrepancy with their order then the Returns Procedure outlined in Clause 10 will need to be followed. 

11.2 The following products shall not be valid for refunds should the Customer wish to cancel their order based on a discrepancy they have made :

11.2a) any customised products 
11.2b) any perishable products/live florals  (Products purchased using our Infinity roses) 

If you change your mind and wish to cancel the contract a non-refundable deposit of 10% will be deducted for the total amount. This deposit is to cover our direct losses for cancellation.


12. Our Liability

12.1 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract.

12.2 We only supply the products for domestic and private use.

12.3 You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

12.4 We do not in any way exclude or limit our liability for:

12.4a) death or personal injury caused by our negligence;

12.4b) fraud or fraudulent misrepresentation;

12.4c) defective products under the Consumer Rights Act 2015.

12.5 As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

13. Intellectual Property

13.1 The Customer shall respect all licence agreements delivered by the copyright owners.

13.2 Flux de Fleur cannot be held responsible or liable for any misuses conducted by the Customer or any third party.

13.3 All trademarks shown on www.fuxdefleur.com belong to Flux de Fleur and must not be copied without prior permission.

13.4 You must not use any part of the materials on the Website for commercial purposes without obtaining a licence to do so from us.

14. International Customers

14.1Customers from outside the UK can pay by International credit card and pay in the currency relevant to their specific location. All other terms and conditions apply

15. Law and Jurisdiction

15.1 These terms and conditions are governed and shall be interpreted in accordance with English Law and shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.

 

Covid 19 - Corona Virus Delays

Due to the unforeseen circumstances during this global pandemic there maybe delays in deliver. Also be aware that our online chat and point of contact maybe delayed due to the lack of staff and our main offices being closed until further notice. We can ensure you our warehouses are sanitized and cleanliness is our highest priority during this time. We shall full fill all orders as usual and shall ensure we maintain our standards.
